Terms of Use & EULA

1. Agreement

These Terms of Use ("Terms") are a binding agreement between you and NestPilotAI LLC ("we", "us"), the operator of the NestPilot AI app and nestpilotai.com (the "Service"). These Terms also serve as the End User License Agreement (EULA) for the app. By downloading or using the Service, you agree to these Terms and to our Privacy Policy. If you don't agree, don't use the Service.

2. Eligibility

You must be at least 18 years old and a parent, guardian or caregiver to use NestPilot AI. Children may not create accounts.

3. Your account

You can sign in with Apple, Google, or a one-time code sent to your email. Keep access to your sign-in method secure. You're responsible for activity on your account. Tell us right away at support@nestpilotai.com if you think someone else is using it.

4. Subscriptions and billing

NestPilot AI is free to download. Some features need a paid, auto-renewing NestPilot Pro subscription. Plans and current prices are shown in the app before you buy. In the United States they are:

• Pro monthly: $14.99 per month
• Pro annual: $89.99 per year
• Family plans, where offered, cover two parent accounts in one shared workspace at the price shown in the app.

• Payment is charged to your Apple ID account when you confirm the purchase.
• Your subscription renews automatically at the same price and length unless auto-renew is turned off at least 24 hours before the end of the current period.
• Your account is charged for renewal within 24 hours before the current period ends.
• You can manage your subscription and turn off auto-renew in your Apple ID account settings after purchase.
• Prices may vary by country and may change. If a price changes, Apple will notify you as its rules require, and you can cancel before the new price applies.

5. Free trial

Eligible new subscribers may be offered a 7-day free trial. The trial starts when you start the subscription in the app. If you don't cancel at least 24 hours before the trial ends, your subscription begins and you are charged for the plan you chose. Trials are limited to one per Apple ID, as Apple determines. If you cancel during a trial, any unused part of the trial ends.

6. Cancellation and refunds

To cancel: open iPhone Settings → your name → Subscriptions → NestPilot AI → Cancel Subscription. You can also tap Manage Subscription in the app.

Cancellation takes effect at the end of the current billing period, and you keep Pro access until then. Deleting the app or your account does not cancel your subscription.

Apple handles all payments and refunds. To ask for a refund, visit reportaproblem.apple.com. We can't issue refunds for App Store purchases ourselves.

7. AI features

NestPilot AI uses artificial intelligence, provided by Google's Gemini API, to generate chat replies, guidance, meal plans, document summaries, insights and message suggestions. AI output can be inaccurate, incomplete or unsuitable for your situation. Check anything important before you act on it. For example, always check ingredient labels against your child's allergies. You decide what to do with AI suggestions, including whether to send a rewritten message.

8. Not professional advice

The Service provides general information and organization tools only. It is not medical, legal, mental-health or financial advice, and it is not an emergency service. In an emergency, call 911 or your local emergency number. For custody, divorce or other legal questions, talk to a licensed attorney. For health concerns, talk to a doctor.

9. Your content

You own the content you add to the Service, such as family profiles, messages, photos and documents. You give us a limited license to host, process and transmit it only to run the Service for you, including sending it to our service providers as our Privacy Policy describes. You confirm you have the right to share the content you upload.

10. Shared co-parent workspaces

When you invite someone to a shared workspace, the content you post there is visible to them. Shared messages, expenses, custody requests and calendar entries form a record both parents rely on. They stay visible to your co-parent even if you later delete your account, and they can be exported by either parent. Post in a shared workspace only what you're comfortable being part of that record.

11. Acceptable use

You agree not to:

• harass, threaten, stalk or abuse anyone, including your co-parent, through the Service;
• post content that is illegal, sexually explicit or exploitative of children, or that violates someone else's rights;
• impersonate anyone or add someone to a workspace without the right to do so;
• attempt to access other users' accounts or our systems without permission, or interfere with the Service;
• reverse engineer the app except where the law allows, or scrape the Service with automated tools;
• use AI features to generate harmful, abusive or illegal content.

You can report abusive messages from the co-parent thread in the app or by emailing support@nestpilotai.com. We may remove content or suspend accounts that break these rules.

12. License to use the app

We grant you a personal, non-exclusive, non-transferable, revocable license to use the NestPilot AI app on Apple-branded devices you own or control, as permitted by the Usage Rules in the Apple Media Services Terms and Conditions. The Service, including its software, design and trademarks, belongs to NestPilotAI LLC and its licensors. Except for this license, we keep all rights.

13. Apple-specific terms

If you downloaded the app from the Apple App Store:

• These Terms are between you and NestPilotAI LLC, not Apple. We, not Apple, are solely responsible for the app and its content.
• Apple has no obligation to provide maintenance or support for the app.
• If the app fails to conform to any applicable warranty, you may notify Apple and Apple will refund the purchase price, if any. To the extent the law allows, Apple has no other warranty obligation for the app.
• Apple is not responsible for addressing any claims from you or third parties relating to the app, including product liability claims, claims that the app fails to meet legal or regulatory requirements, and claims under consumer protection, privacy or similar laws.
• If a third party claims the app infringes its intellectual property rights, we, not Apple, are responsible for investigating, defending, settling and resolving that claim.
• You confirm you are not located in a country subject to a U.S. Government embargo or designated as a "terrorist supporting" country, and you are not on any U.S. Government list of prohibited or restricted parties.
• You must comply with any applicable third-party terms, such as your wireless data service agreement, when using the app.
• Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.

Where these Terms are silent, Apple's Licensed Application End User License Agreement applies.

14. Disclaimers

The Service is provided "as is" and "as available", without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose and non-infringement. We don't promise the Service will be uninterrupted, error-free or that AI output will be accurate.

15. Limitation of liability

To the fullest extent the law allows, NestPilotAI LLC will not be liable for indirect, incidental, special, consequential or punitive damages, or for lost data, profits or goodwill, arising from your use of the Service. Our total liability for any claim relating to the Service is limited to the greater of the amount you paid for the Service in the 12 months before the claim or $50.

Some places don't allow these limits, so they may not fully apply to you.

16. Indemnity

You agree to defend and indemnify NestPilotAI LLC against claims, losses and expenses, including reasonable attorneys' fees, arising from your content, your misuse of the Service or your breach of these Terms.

17. Termination

You can stop using the Service and delete your account at any time. We may suspend or end your access if you break these Terms or if we need to for legal or security reasons. If we discontinue the Service, we'll give reasonable notice when we can. Sections 9, 10 and 14 to 18 survive termination.

18. Governing law and disputes

These Terms are governed by the laws of the United States and the state in which NestPilotAI LLC is organized, without regard to conflict-of-law rules. Before filing a claim, please contact us so we can try to resolve it informally. Nothing in these Terms limits rights you have under consumer protection laws that cannot be waived.

19. Changes to these Terms

We may update these Terms. We'll change the date at the top, and for significant changes we'll tell you in the app or by email before they take effect. If you keep using the Service after that, you accept the updated Terms.
